Access to the Portal is free of charge, except for the cost of the connection through the telecommunications network supplied by the access provider contracted by users.

Certain services are exclusive to our clients and their access may be restricted. Specific terms and conditions, regulations, and instructions may be established which, where applicable, replace, supplement and/or amend this Legal Notice and must be accepted by the User prior to the provision of the corresponding service.

The services provided by EcomX Limited shall be subject to the pricing indicated, where applicable, in each of the commercial offers made available to clients and/or potential clients.

The use of the Portal confers the status of user (hereinafter, the "User") and implies full acceptance of all the provisions included in this Legal Notice.

Users should read this Legal Notice carefully each time they intend to use the Portal, as it may be subject to modifications.

All contents of the Portal, understood to include, without limitation, texts, photographs, graphics, images, icons, technology, software, links, audiovisual or sound content, as well as its graphic design and source codes (hereinafter, the “Content”), are the intellectual property of EcomX Limited or of third parties. No rights of exploitation recognised under applicable intellectual property law shall be understood to be transferred to the User, except those strictly necessary for the use of the Portal.

The trademarks, trade names, or distinctive signs appearing on the Portal are the property of EcomX Limited or third parties. Access to the Portal shall not be understood as conferring any right to the aforementioned trademarks, trade names, and/or distinctive signs.

3.1 General

The User undertakes to use the Portal in accordance with the law and this Legal Notice. The User shall be liable to EcomX Limited or to third parties for any damages that may arise as a result of a breach of this obligation.

The use of the Portal for purposes harmful to the property or interests of EcomX Limited or third parties, or which in any other way overload, damage, or render useless the networks, servers, and other computer equipment (hardware) or software applications of EcomX Limited or third parties, is expressly prohibited.

3.2 Content

The User undertakes to use the Content in accordance with the law and this Legal Notice, as well as with any other conditions, regulations, and instructions that may be applicable.

The reproduction, copying, distribution, public communication, transformation, or modification of the Content is prohibited except in cases authorised by law or expressly consented to by EcomX Limited or by the holder of the relevant rights of exploitation.

The extraction and/or reuse of a substantial part of the Content, as well as of any databases made available by EcomX Limited to Users, is strictly prohibited.

3.3 Links to the Portal

Any Internet user who wishes to insert links from their own websites to the Portal must comply with the following conditions, without ignorance thereof exempting them from legal liability:

• The link may only connect to the homepage of the Portal and may not reproduce it in any form (inline linking, copying of text, graphics, etc.).


• The creation of frames or environments of any kind that surround the Portal or allow the Content to be displayed through Internet addresses other than those of the Portal is prohibited, especially when displayed together with third-party content in a manner that:
  1. (i) may cause confusion about the origin of the service or Content;
  2. (ii) constitutes unfair comparison or imitation;
  3. (iii) exploits the reputation of EcomX Limited’s brand; or
  4. (iv) is otherwise prohibited by applicable law.


• No false, inaccurate, or incorrect statements about EcomX Limited, its partners, employees, or clients, or about the quality of its services may be made from the linking website.


• It shall not be implied on the linking page that EcomX Limited has authorised or approved the insertion of the link or that it sponsors, collaborates, verifies, or supervises the services of the linking party.


• The use of any word, graphic, or mixed trademarks or any other distinctive signs of EcomX Limited within the linking website is prohibited, except where permitted by law or expressly authorised by EcomX Limited, and always provided that a direct link to the Portal is allowed in the manner established in this clause.


• The website establishing the link must comply fully with the law and shall not contain, link to, or display content that:
  1. (i) is unlawful, harmful, or contrary to morality (e.g., pornographic, violent, racist);
  2. (ii) may create the false impression that EcomX Limited endorses, supports, or adheres to the ideas, statements, or expressions of the linking party; or
  3. (iii) is inappropriate or irrelevant to EcomX Limited’s activities.

4.1 Service Quality

Access to the Portal does not imply any obligation on the part of EcomX Limited to monitor for the absence of viruses, worms, or other harmful computer elements. It is the User’s responsibility to have appropriate tools for the detection and disinfection of harmful software. EcomX Limited shall not be liable for any damage caused to the computer equipment of Users or third parties during the provision of the Portal.

4.2 Service Availability

Access to the Portal requires services supplied by third parties, including transport through telecommunications networks whose reliability, quality, continuity, and operation are outside the control of EcomX Limited. Consequently, services provided through the Portal may be suspended, cancelled, or become inaccessible, prior to or during the provision of the Portal service. EcomX Limited shall not be liable for any damages of any kind caused to the User by failures or disconnections in telecommunications networks that result in suspension, cancellation, or interruption of the Portal.

4.3 Linked Content and Services

The Portal may include technical linking devices, directories, and even search tools that allow the User to access other Internet websites and portals (hereinafter, “Linked Sites”). In such cases, EcomX Limited acts as an intermediary service provider and shall only be responsible for the content and services supplied on the Linked Sites to the extent that it has actual knowledge of their unlawfulness and has not deactivated the link with due diligence.

In no event shall the existence of Linked Sites presuppose the existence of agreements with their owners or operators, nor the recommendation, approval, or endorsement by EcomX Limited of the statements, content, or services offered therein.

EcomX Limited does not monitor or control the content and services of Linked Sites and therefore shall not be liable for damages caused by their illegality, quality, outdatedness, unavailability, error, or uselessness, or for any other damage not directly attributable to EcomX Limited.

In the event that the User or any other Internet user becomes aware that any Linked Site or any other content accessible through the Portal is unlawful, harmful, denigrating, violent, or contrary to morality, they may notify EcomX Limited providing the following information:

• Personal data of the notifier (name, address, telephone number, and email address).
• Description of the facts revealing the unlawful or inappropriate nature of the content or Linked Site.
• Where rights such as intellectual or industrial property are infringed, the personal data of the holder of the infringed rights (if different from the notifier), together with proof of ownership and, where applicable, proof of representation.
• An express declaration that the information provided in the notification is accurate.

Receipt of such communication by EcomX Limited shall not, in itself, constitute effective knowledge of the activities and/or content indicated by the notifier.

This Legal Notice shall be governed by and construed in accordance with the laws of Hong Kong, without prejudice to any mandatory consumer protection rules that may apply depending on the User’s country of residence.
